Duncan McRae

Duncan McRae was a woodcutter and contractor.  He worked on the Virginia and Gold Hill Water Company tunnel north of Marlette Lake and had contracts to supply wood for flume construction.  McRae also had contracts with the Sierra Nevada Wood and Lumber Company.  He was the subject of at least two legal suits in Ormsby County for unpaid debts.  Many of his contracts are included in the records of the V&GHWC.

2nd Judicial District Court (Ormsby County):  2NDJUDCT-0021 #35, case #492.  Mason & Co. plaintiff vs McRae & Co. defendant.  Filed Dec. 4, 1880.  On March 1, 1879 the plaintiff sold and delivered to the defendant provisions, tools and woodchopper's supplies totaling $13,925.56.  The Defendant only paid $3,785.75 leaving an unpaid balance of $10, 129.81.  McRae did not appear for the trial so the court found for the plaintiff and directed the Sheriffs of Ormsby and Washoe Counties to attach McRae's property.  Ormsby County served a notice of garnishment to the agent of the firms of Fair & Mackay Flood & O'Brien; the Virginia and Gold Hill Water Company; and the Sierra Nevada Wood and Lumber Company for any money they owed the defendant.  The superintendent of the latter two companies (J.B. Overton) submitted statements showing the defendant had been paid for contracts but not completed the contracts, leaving goods and labor owed to the companies.  The Washoe County Sheriff levied upon cords of wood, pack mules, horses, "apparojoes" and fixtures, wagons, harness, and buckboard to be sold at auction Dec. 24, 1880.

2nd Judicial District Court (Ormsby County):  2NDJUDCT-0024 #19, case #604, D. Circe, plaintiff vs Duncan McRae and William Fitzpatrick, defendants.  Filed Dec. 6, 1880.  The Plaintiff performed $723.00 worth of work with teams (of horses) for the defendant on December 1, 1880 but was not paid.  The defendant also owed the plaintiff for a stable bill of $150; for money borrowed at various times amounting to $96.50; and to list of people for work and labor done for plaintiff on defendant's behalf.  These claims totaled $2,782.89 and costs.  The court found for the plaintiff when the defendant did not appear.  Ormsby County served a notice of garnishment to the agent of the firms Fair & Mackay Flood & O'Brien; the Virginia and Gold Hill Water Company; and the Sierra Nevada Wood and Lumber Company for any money they owed the defendant.  The superintendent of the latter two companies (J.B. Overton) submitted statements showing defendant had been paid for contracts but not completed the work, leaving goods and labor owed the companies.  All levies were made subject to levies made in the suit of Horatio Mason & Joseph Mason (Mason & Co.) against defendant (case #492, 2nd Judicial District Court).
